Memorandum that on this twenty sixth day of January 1897 John Tennant of
Gate Bridge, Galphay near the City of Ripon in the County of York, Gentleman
has deposited with Margaret Elizabeth Brear of Roseville, Ripon aforesaid Widow,
Richard Wigfull of Sheffield in the said County, Brewer and Thomas Thompson
of Beverley in the said County, Corn Merchant, the documents comprised in the
Schedule hereto with intent to create an equitable mortgage upon all the property
comprised therein or to which the same relate for securing the repayment by the
aid John Tennant to the said Margaret Elizabeth Brear, Richard Wigfull and
Thomas Thompson on the — day of —— next of the sum of £1000 this day
advanced and paid by the said Margaret Elizabeth Brear, Richard Wigfull and
Thomas Thompson to the said John Tennant together with interest thereon
after the rate of £3 10s 0d per cent per annum computed from the date thereof.
And the said John Tennant agrees at any time or times during the continuance
of this security upon the request of the said Margaret Elizabeth Brear,
Richard Wigfull and Thomas Thompson but at the cost of the said John Tennant
to execute to the said Margaret Elizabeth Brear, Richard Wigfull and
Thomas Thompson a legal mortgage of the said property with such powers and
provisions and in such force as the said Margaret Elizabeth Brear, Richard Wigfull
and Thomas Thompson may require for further security the payment of the said
principal money and interest. And it is hereby further agreed that in the meantime
and until a legal mortgage is executed as aforesaid the said Margaret Elizabeth Brear,
Richard Wigfull and Thomas Thompson their executors administrators and assigns
shall have all the powers conferred on mortgagees by sections 19 to 24 both
inclusive and by section 67 of the Conveyancing and Law of Property Act of 1881
in like manner as if these presents have been a mortgage by deed and that the said
John Tennant and all persons deriving will under him shall upon any sale made
under the said Statutory power execute and do such assurances and things for
vesting in the P???? the legal state of the property sold as shall be required in that
behalf by the person or persons in whom the sale shall have been made.
